  • Who are the Beneficiaries of the Foundation?
    There are three nominated beneficiaries in the Foundation Trust Deed – Kingston Soldiers Memorial Hospital. Kingston Community School Building Fund. Kingston SE Branch of the National Trust of SA. The Trustees have a discretion as to the amounts that may be distributed each year according to the needs of the Beneficiaries.
  • Can a Will bequest be made in favour of the Kingston Community Foundation?
    Foundations are frequently nominated in wills of deceased estates allowing the community to benefit from the gift for many years to come.
  • Can I nominate which Beneficiary I would like to benefit from my donation?
    Yes, significant Donors can nominate their preferred beneficiary.
  • Are donations Tax deductible?
    Yes, As the Kingston Community Foundation is a registered Deductible Gift Recipient (DGR), all donations given to the Foundation are tax deductible in the year the gift is made.
  • Are there any conflicts of interests with the Directors of the Trustee?
    No, under clause 5.2 of the Trust Deed, no benefit is permitted to a Director of the Foundation.
  • Can any person be appointed as Director of the Trustee?
    No, the Australian Tax Office requires that the majority of the Directors be qualified “Responsible Persons”. A schedule of eligible people is published in the ATO regulations.
  • Are Community Foundations in popular use?
    Yes, Community Foundations and Charitable Foundations are becoming popular as it provides a legitimate and regulated structure for community groups to operate within.
  • What regulations cover the operation of Foundations?
    Annual audited financial reports are required to be lodged with the Australian Charities and Not-for-profits Commission - ACNC – and the Australian Tax Office - ATO - to ensure compliance with the relevant laws and regulations.
  • Does the Foundation pay tax?
    No, the Foundation is a registered tax-exempt Not-for-Profit Charity.
  • Why did the Foundation purchase the Old Wool Store?
    Successful traditional fund-raising activities have become difficult to operate to raise funds to support local organisations due to the pressure of modern life. The Directors accepted the challenge of creating a capital fund that would generate income well into the future.
  • Why the Old Wool Store?
    Since the unfortunate death of the previous owners who had operated a very successful Licensed Café and Restaurant, the building remained unoccupied, and this has been a significant loss felt by the Community. The building is also Heritage Listed which will ensure the character of the building is maintained. The property will be leased to a restauranteur on a long-term commercial lease, so providing an annual income which can be distributed to the Beneficiaries.
  • Can the Foundation raise the money required to acquire the property?
    The Directors believe there is significant community support for this initiative as indicated by several significant contributions made to date. Yes, it is a major challenge but the Directors are up for it!
